Smoke-Free Transition Reaches It's Final Phase
Posted on May 28th, 2019

The final phase of the transition plan for The Hammond North to become a smoke free building is about to begin.  The Resolution includes tobacco and marijuana smoke. To prepare for this, we wanted to communicate some reminders of what to expect.
Below is the paragraph from the Resolution regarding the final phase:
“Starting on June 1, 2019, and thereafter, this Resolution shall be in full effect. Residents will be required to smoke outside of the Condominium Building at least 25 feet away from any entrance to the Condominium Building or in any designated indoor smoking lounge that may be made available by the Association. Any resident who fails to abide by this Resolution shall be subject to enforcement assessments to be levied against the Unit in which the resident resides, as further detailed below, or to a suit for injunctive relief.”
Enforcement assessments shall be levied according to the following schedule starting on June 1, 2019:
a. For a first offense in a calendar year, the assessment shall be $50.00;
b. For a second offense in a calendar year, the assessment shall be $75.00;
c. For a third offense in a calendar year, the assessment shall be $100.00;
d. Thereafter, the assessment for each subsequent offense in a calendar year shall be $125.00
e. Unpaid enforcement assessments shall be a lien upon the Unit in which the resident resides and may be collected in accordance with the Association’s collection policy in effect at the relevant time.
The designated smoking areas are located at the picnic table on the south end of the parking lot going out the front door, out the LL exit near the loading dock, 25 feet from the door, and on the LL level of the garage on the southeast corner.  Always use the provided smoker’s poles to dispose of cigarette butts.  Do not throw cigarettes butts on the ground!
The only indoor exception would be for residents who filed with the Board a petition for exception due to permanent mobility disability by Jan. 1, 2019 and had their petition granted.
If, after June 1, 2019, a resident reasonably believes that someone is smoking anywhere in the Condominium Building, that resident must submit their complaint, along with any relevant details evidencing their reasonable belief, in writing to the Association’s managing agent.  Upon receiving a complaint and the written details giving rise to the complaint, the Association’s managing agent will investigate the matter using reasonable means to do so.
Relevant information and forms are available in the office or from our website hammondnorthcondos,com under the Resident Login tab.
If you have any further questions, please feel free to contact the management office.
